Welcome to HOUSES (ASIA) LIMITED website (the ‘Site’) and we hope you enjoy your stay. We provide this Site as a service to its customers. By using the Site and/or placing an order, you agree to be bound by these Terms and Conditions and any Orders placed by you are bound by these Terms and Conditions. If you do not agree to these Terms and Conditions, please do not use the Site.

The Site is provided solely for your personal and noncommercial use. You may not use the Site for any commercial purpose. We reserve the right, at our sole discretion, to change, modify, add, amend or remove any part of these Terms and Conditions from time to time and it is your responsibility to check these Terms and Conditions from time to time for changes. It is a hassle we know, but we definitely would advise you to do so. We may modify or withdraw, temporarily or permanently, the Site (or any part of it) and we shall not be liable to you or any third party for any modification to or withdrawal of the Site. If you do not agree to our right to change the Site or the Terms and Conditions from time to time, please do not use the Site.

Please note that these Terms and Conditions do not affect your statutory rights as a consumer.

The entire content of the Site is copyrighted as a collective work under applicable copyright laws, and coordination, arrangement and enhancement of the content.

You may download, print or store selected portions of the Site’s content, provided you (i) only use these materials for your own personal, noncommercial use, (ii) do not copy or post the content on any network computer or broadcast the content in any media, and (iii) do not modify or alter the content in any way, or delete or change any copyright or trademark notice. No right, title or interest in any content or materials is transferred to you as a result of any such activities. ·HOUSES·SHOP· reserves full title and full intellectual property rights on any content you download, reproduce, print, redistribute or store from this Site.

The name ·HOUSES·SHOP· and our logo are both registered trademark. Except as noted above, you may not copy, download, reproduce, modify, publish, redistribute, re-transmit, publicly display, publicly perform or create derivative works from the content without first obtaining written permission from ·HOUSES·SHOP·.

 

We will do our best to ensure that all Product Descriptions are correct at the time when the relevant information was first entered onto the Site. We have made every effort to display as accurately as possible the appearances, colours, textures or finishes of our Products. What you see will depend on your computer model, screen/monitor and we are therefore unable to guarantee that a Product’s images are an accurate representation of the actual merchandise. Please refer to our Returns Policy if you are unhappy with your Order.

 

The Site features Products that have been carefully selected for sale on it. Products are subject to availability so once a Product has sold out it will be taken off the Site and/or marked as sold out/out of stock at the earliest opportunity and may not be available again. As there is a delay between the time when your Order is placed, and the time when the Order is accepted, the stock position relating to particular Products may change. If a Product you have ordered goes out of stock before we accept your Order, then ·HOUSES·SHOP· shall not be liable to you for being unable to provide that Product. If such a situation arises, then we shall notify you as soon as possible and you will not be charged for the out of stock Product.

 

All Product prices are in Hong Kong Dollar ($). Prices are correct at the time that the Product Description was first entered on to the Site. Prices of Products may change from time to time and any promotional discounts or offers may also be withdrawn at any time.

Although we try to ensure all our Products’ prices displayed in the Product Description are accurate, silly errors may sometimes occur. We therefore reserve the right to correct any errors, inaccuracies or omissions and to change and update information at any time without prior notice (including after you have submitted your order). Please note that such errors, inaccuracies or omissions may relate to Product description, pricing and availability.

If we discover an error in the price of a Product you have ordered we will contact you as soon as possible in order to notify you of the error and find out how you would like us to proceed with your order. We apologize for any inconvenience this may cause you. If we are unable to contact you, we will treat your Order in respect of the incorrectly priced item as cancelled.

If we have mistakenly listed the price of a Product lower than it should be, then we, in most cases, will honour the lower price listed. However, we reserve to right to refuse or cancel any orders placed for any Products listed at the incorrect price. We also reserve the right to refuse or cancel any Orders whether or not the order has been confirmed and your credit card charged. If your credit card has already been charged for the purchase and your order is canceled, we shall issue a payment to your credit card account or online bank account in the amount of the incorrect price.

 

You must be 18 years old or older to use this Site. If you are under 18, you may only use this site with the agreement of, and under the supervision of, a parent or guardian. If you do not qualify, please do not use this Site.

 

You must provide us with complete and accurate delivery address information. This includes not only the address that your Order is going to, but also the name of its recipient. We cannot be liable for the delivery of your Order to the wrong address or the wrong person as a result of you supplying us with incomplete or inaccurate information.

We do not send to PO BOX addresses & freight forwarders.

Please note that delivery of your Order may take longer during sale or other busy periods.

 

A fixed rate of HK$30 is charged for the Orders which are below HK$800. There will be free of charge if the Orders are more than HK$800.

Please notify us if your Order has not been received within 14 days of Order confirmation.

We offer deliveries via the below:

Via S.F. Express: Will be delivered using the S.F. Express service and so will require a signature on receipt.

Delivery lead times of your Order within the H.K. will usually take 7 days.

We do not guarantee next day delivery.

 

A standard rate with HK$200up for all international Orders, which the custom fee and VAT will not be included.

International delivery charge(s) applicable to your Order will be applied at the checkout and the amount will be added to the total amount of your Order.

Delivery lead times of your Order to an international address will vary according to its destination, but will usually take 7 -14 days to the rest of the world. We will make every effort to deliver your Order within the estimated timescales. However delays are occasionally inevitable due to unforeseen factors or events outside our control, for example, material shortages, travel or transportation disruption, import delays or higher than anticipated demand. ·HOUSES·SHOP· shall not be liable for any delay or failure by us to deliver your Order within the estimated timescales.

International delivery option is automatically calculated as part of the checkout process when you specify a delivery address outside of H.K.. For the purposes of these Terms and Conditions, we consider “international delivery” to relate to the delivery of your Order to a country outside of H.K..

We offer deliveries via the below:

Via UPS: Will be delivered using the UPS service and so will require a signature on receipt.

Please notify us if your Order has not been received within 28 days of Order confirmation.

 

Returning of products confirmed in any circumstances will not be accepted.

 

Refunds would not be possible for any dispatched & Sale , Clearance products in any circumstances.

 

We reserve all the rights to amend these Terms without noticing from time to time.

These rules will be deemed incorporated into each competition except to the extent that any specific instruction in a competition provides otherwise.

By entering the competition entrants will be deemed to have read and understood these Terms and be bound by them. All of our decisions will be final and binding and no correspondence will be entered into.

Any person who is an employee or an immediate family member of an employee of ·HOUSES·SHOP·· or any other person who is directly connected with ·HOUSES·SHOP· of any particular competition is ineligible to participate.

Competitions are only open to anyone unless certain restrictions are specified or implied.

All entrants are to be aged 18 or over unless any other age restriction is specified or implied. Entrants should, if under 18, obtain permission in advance from their parent or guardian.

All entries must be received by the closing date specified in the competition.

Answers will be entered upon submission. No responsibility will be taken for any answers that are misdirected, lost for technical or other reasons or received after the closing date.

We reserve the absolute right to disqualify without notice any entries to any competition which we consider have used improper technical means to enter and/or we believe is fraudulent.

Entrants are liable for their costs to access computer networks.

We take the risk of Internet fraud very seriously. With the volume of fraudulent credit card transactions increasing, we make every effort to ensure all Orders are thoroughly checked using the information already supplied. There is a possibility we may contact you to make additional security checks and we ask for your co-operation to enable us to complete them. We will not tolerate fraudulent transactions and such transactions will be reported to the relevant authorities.

By accepting these terms and conditions you consent to such checks being made. In performing these checks personal information provided by you may be disclosed to a registered Credit Reference Agency which may keep a record of that information. You can rest assured that this is done only to confirm your identity, that a credit check is not performed and that your credit rating will be unaffected. All information provided by you will be treated securely and strictly in accordance with the Data Protection Act in H.K..

 

Please carefully choose the material you post on the Site and which you provide to other Users. You must not misuse the Site in any way, shape or form. You must not: send or otherwise post unauthorised commercial communications to Users (such as spam); upload viruses, trojans, worms, logic bombs or other malicious code; corrupt data; cause annoyance to other Users; post material that is hateful, threatening, pornographic, or that contains nudity or graphic or gratuitous violence; use the Site to do anything unlawful, misleading, malicious or discriminatory; facilitate or encourage any violation of these Terms and Conditions.

We will not be liable, in contract, tort (including, without limitation, negligence), pre-contract or other representations (other than fraudulent or negligent misrepresentations) or otherwise out of or in connection with the Terms and Conditions for any direct, special, incidental, indirect or consequential damages including loss of profit or loss of opportunity that result from the use of, or the inability to use, the material or Content on the Site or the performance of any Product purchased through the Site or the conduct of other Users of the Site, even if ·HOUSES·SHOP·· has been advised of the possibility of such damages.

The Site may also contain links to other websites, which are not operated by ·HOUSES·SHOP·. When you activate any of these you will leave the Site and we have no control over, and will not accept any responsibility or liability in respect of, the material on any website which is not under our control.

You agree to fully indemnify, defend and hold us and our agents, officers, directors, employees and suppliers, harmless immediately on demand, from and against all claims, liability, damages, losses, costs and expenses, including reasonable legal fees, arising out of any breach of these Terms and Conditions (including Community Area Rules) by you or any other liabilities arising out of your use of the Site, or the use by any other person accessing the Site using your Personal Information.

We may terminate your use of the Site immediately if we consider that you have breached these Terms and Conditions.

Nothing in these Terms and Conditions shall exclude or limit our liability for death or personal injury resulting from our negligence or that of our servants, agents or employees.

 

If any part of the terms and conditions shall be deemed unlawful, void or for any reason unenforceable, then that provision shall be deemed to be severable from these terms and conditions and shall not affect the validity and enforceability of any of the remaining provisions of the terms and conditions.

 

No waiver by use shall be construed as a waiver of any preceding or succeeding breach of any provision.

 

Each provision of these terms and conditions shall be construed as separately applying and surviving even if for any reason one or other of those provisions is held to be inapplicable or unenforceable in any circumstances.

 

We may change these Terms and Conditions at any time. If any clause of these Terms and Conditions shall be deemed unlawful, void or for any reason unenforceable, then that clause shall be deemed severable from the Terms and Conditions and shall not affect the validity and enforceability of the remainder of these Terms and Conditions, which shall continue to have full force and effect.

We will not be responsible to you for any delay or failure to comply with our obligations under these Terms and Conditions if the delay or failure arises from any cause beyond our reasonable control.

If you breach these Terms and Conditions and we take no action we will still be entitled to use our rights and remedies in other situations where you are in breach. No waiver by us shall be construed as a waiver of any proceeding or succeeding breach of any clause of these Terms and Conditions.

We reserve the right to amend, remove or vary the Site, any page of the Site, any Content on the Site, or any service offered on the Site at any time and without notice.

 

These Terms and Conditions govern our relationship with you and supersede any and all preceding and contemporaneous agreements between you and ·HOUSES·SHOP·. Any waiver of any provision of the Terms and Conditions will only be effective if in writing and signed by one of the Directors of ·HOUSES·SHOP·. You confirm that, in agreeing to accept the Terms and Conditions, you have not relied on any representation save insofar as the same has expressly been made a clause of these Terms and Conditions and you agree that you shall have no remedy in respect of any representation. Your statutory tights are not affected by these Terms and Conditions.

The following definitions shall apply to these Terms & Conditions:

“Coupons” means a coupon issued and emailed to you by ·HOUSES·SHOP· only;

“Order” means an online transaction made by you via the Site for one or more Products, to which these Terms and Conditions apply.

“Personal Information” means the details you provide to us when you use the Site, such as your name, e-mail address, billing address, delivery address, telephone number, Product selections, credit card or other payment information and a password.

“Product” means a product displayed for sale on the Site.

“Product Description” means that part of the Site where certain terms and conditions in respect of the individual Product are provided which shall include, but not be limited to, all details, prices (cost of the Product and delivery charges), photographic representations and descriptions of a Product.

“Terms and Conditions” means these terms and conditions.

“We” or “us” means ·HOUSES (ASIA) LIMITED·.

“Site” means the website located at www.houses-asia.com or any subsequent URL which may replace it.

“H.K.” means, for the purposes of these Terms and Conditions, Hong Kong.

“Users” means the users of the Site collectively.
